Copyright and Ownership
All photographs, videos, and digital assets (the "Work") produced by Leighton James / The Property Photographer are protected under the Copyright, Designs and Patents Act 1988.
Leighton James retains full, perpetual ownership and copyright of all Work. The transfer of digital files to the Client represents the granting of a Usage Licence, not a transfer of ownership or title.
2. Grant of Licence (The "Limited Licence")
Subject to payment in full of the relevant invoice, the Client is granted a non-exclusive, non-transferable licence to use the Work for the following purposes:
Self-Promotion: Inclusion in the Client’s own website, social media channels, and printed marketing materials (e.g. brochures, portfolios, and pitch documents).
Editorial: Use in industry-related blog posts or internal newsletters.
Prohibition on Sub-Licensing: This licence is granted to the Client only. The Work may not be sold, leased, or gifted to any third party (such as contractors, sub-vendors, or magazines) without express written consent and potential additional fees.
3. Third-Party Licensing & Cost Sharing
If a third party (e.g. an architect, builder, kitchen supplier, or interior stylist) wishes to use any of the images, they must obtain a separate Third-Party Licence directly from the Photographer.
Referrals: Please direct all third-party enquiries to Leighton James.
Multi-Party Shoots: If you intend to share the costs of a shoot with another business upfront, please notify the Photographer prior to the shoot date so that a "Cost-Sharing" agreement can be arranged and the appropriate licences issued to all parties.
4. Credit and Acknowledgements
Proper attribution is a legal right of the author and is vital for our business. The Client agrees to include a credit line or tag whenever the Work is published. This should be clear and not hidden in amongst hashtags.
Social Media: "Photography by Leighton James | @thepropertyphotographer"
Web/Print: "Photography by Leighton James, The Property Photographer"
Third-Party Requirement: Where a third party uses the images via a purchased licence, they are requested to credit both the Photographer and the original commissioning Client (e.g. the Designer).
5. Alterations and Post-Processing
The Work delivered represents the Photographer’s professional artistic vision and brand standards.
No Modifications: The Client shall not apply filters (e.g. Instagram filters), crop significantly, or otherwise alter the Work, including the use of AI-generative "fills" or "extensions" without prior permission.
Adjustment Requests: If specific retouching or additional post-production is required after delivery, please contact the Photographer. Additional fees may apply for extensive work outside the original brief.
